Lawyer says police wrong to raid Pure Bliss adult store

New Bern, North Carolina- A lawyer for Pure Bliss said Friday that his client may take legal action against the city of New Bern and its Police Department for a raid this week. The lawyer, Glenn Barfield of Goldsboro, represents store owner Greg Sakas of Goldsboro. Barfield said he thought there was an understanding with New Bern police that there would be no more raids until charges from a January raid were heard in court.

In January, Sakas and two others were charged with operating more than one adult business under one roof. Barfield said Friday that New Bern’s city Planning Department had never determined that Pure Bliss was an adult business. Mike Avery, New Bern city planner, referred all calls to City Attorney Michael Scott Davis. Davis said the Planning Department would take its direction from the district attorney.

Scott Thomas, Craven County District Attorney, said the January case would be prosecuted.
“I have not seen the report of the latest case,” Thomas said. “The first I heard of it was by reading it in the newspaper.” Davis said that adult businesses must have a certain percentage of earnings from the non-adult portion of the store and a certain percentage of earning from “adult” items. He said the city does not employ forensic accountants and doesn’t have the staff to audit the store’s specific income. Pure Bliss does have a privilege license to do business in New Bern. It was issued to Sakas in March 2004.

According to a search warrant that police obtained for the latest raid, an undercover officer, Detective Malydia Owen, spoke with an employee of the company. Owen swore that the employee told her that the majority of the business profits came from the adult items in the back room and referred to the front of the business as being “lame.” Owen said the employee identified himself as a regional manager and said he worked in several stores (owned by Sakas). Owen was wearing a hidden recorder and other detectives electronically monitored the conversation from outside the business. “It appears the New Bern police are undertaking a campaign against what we sell,” Barfield said.

He said he thought the police action was a violation of the First and Fourth Amendments. The First Amendment guarantees free speech and the Fourth Amendment guarantees against search and seizures unless there is a probable cause. “If the state tries these cases, they will go higher than District Court where a judge decides innocence or guilt. There are complex statutes in this case that will be heard,” Barfield said. The Rev. Walter Leake of the Craven-Pamlico Christian Coalition said he has talked to police about Pure Bliss and voiced complaints. “We quietly picket the business on the fourth Sunday of each month, except during December, because of Christmas,” Leake said Friday.

The charges filed this week included counts of selling a controlled substance called “rush” in an inhaler. Barfield said the store does not sell “rush” and the charge is wrong. Owen swore in the warrant that she bought the product during two visits to the store. She said in affidavits that the store clerk told her the item was “rush” but the store had to market it as “Head Cleaner.”

The front part of the store sells lingerie and general tapes. Owen said an employ admitted her through an electronically controlled door to a room containing adult material.
The store was open Friday with a full parking lot in spite of the fact that police say they confiscated several hundred adult videos and magazines. The January charges are scheduled to be heard Sept. 27. The latest charges are set to be heard Oct. 25.

In the latest case,
Sakas, 59, was charged with maintaining a multi-adult establishment and selling a controlled substance. Store manager Michael Squires, 28, was charged with two counts of operating a multi-adult establishment and two c
ounts of possession of a toxic substance and two counts of selling a toxic substance.

In Monumental Double Cross Greg Sakas Raided Again, Cops Cite "Controlled Substances"

New Bern, North Carolina- After assurances from authorities that his store was considered a demilitarized zone until issues could be resolved in court later this month, Greg Sakas' adult establishment was again raided by police. Sakas was due in court September 27 over a police raid in January. But now Sakas faces brand new charges: including the fact that he's been dealing, allegedly, in controlled substances with intent to sell. The so-called controlled substance is video head cleaner. "We've been raided again after promises were made," said Sakas. During the course of the raid, Sakas' store manager, Michael Andrew Squiers was arrested.

The police came with a warrant they had Squiers' name on it. "They knew his name, date of birth- everything- I don't know how they got all of that said Sakas. "They were getting ready to put him in a jump suit when we finally got him bailed out Tuesday night," continues Sakas. "And I'm waiting for an arrest warrant for me, now." Sakas said he wasn't able to bail out his manager initially but did so later in the evening when they had Squiers in the holding tank. Sakas said this was a manager who had started with him about three months ago and knew the situation from January.

"We had told him we had verbal agreements with the city. The bastards lied to us."

Sakas says his manager was charged on six different counts.
"They actually had him on his knees in handcuffs and jerked him out of that store because he wouldn't cooperate. he's a strong man." "And they're saying we had a controlled substance," Sakas goes on to say. "They're calling it 'Rush' but it's video head cleaner. They're saying it's a controlled substance. If we had known this stuff was illegal we would never have sold it. They're calling it narcotics- but his bond was only $1,000. Does that make sense?"

According to Sakas, he can't get back into his own store, that cops have been there all night. "We think the phones are tapped- this has been an ongoing thing." Religious Right picketers had tried disrupting Sakas' business a couple of months ago but that didn't work. And Sakas has long suspected the police were behind that as well. "Now with us two weeks from going to court this has happened. They didn't have a case. And they're still in the store with forensics, everything. We have not been able to get into the store."

Police entered Sakas' store this time at 3pm, with Sakas noting the irony of it being 9/11. "This time they read the manager his rights and asked for his key," says Sakas. "When he refused to give them anything, they just carted him off to jail." According to Sakas, the cops sent in an undercover policewoman to make several hundred dollars of purchases in order to make a new case. "She bought the merchandise with narcotics money," Sakas contends. "It had to be her. They had been sitting across the street watching the store. It's been an ongoing thing, total harassment. If this isn't police brutality, what the fuck is it?"

"This was after the police chief [Frank Palumbo] was in a meeting where the D.A. and city attorney stated go on and operate and we'll see what we can do about working this out. And this is what was told, verbally, to my attorney."

"We're livid now," Sakas goes on to say. "They wouldn't put it in writing but they said, look, we won't do anything but we'd give you notice. They didn't give us notice and waited until 9/11 on top of that. How ironic is this whole thing." "This time is worse than the first- they've actually taken a full inventory. It's a mess." Sakas wasn't there when his store was raided. "They're trying to break me," states Sakas. "If they break me, where are we going with this? If people don't want to help, it's fine. It's really great. Because you know something? I don't know if I can hold down the fort through all of this any more, finncially. And they've got their foothold now."

Sakas estimates that cops have taken at least $50,000 in inventory from his store.

"And you think we're going to get anything back? The deposit from the previous night was not made. They wanted our money and everything. The manager refused to give them anything. He told them you're going to have to find it yourself. They're tearing that whole store apart. They are ransacking it."

"Everybody in North Carolina is now really open," Sakas thinks. "If they think they're not not, they're crazy as hell. I've got to try to find some people that are willing to help." Sakas said another of his employees- a clean up woman- was intimidated by police, thinking she was a clerk.

"They were going to arrest her, too."

Woman Solicited 10 Year-Old Girls for strip club at York fair

YORK, Pa. - Police were investigating reports that a woman at the York Fair tried to recruit girls as young as 10 to work at a strip club.

A 13-year-old girl told police that a woman propositioned her Wednesday at the fair about stripping at an Adams County club. "The woman did approach her and solicit her to engage in exotic/strip dancing , even after she was told (the girl) was 13," said West Manchester police Detective Sgt. Jeff Snell. The account matched those given by a bathroom attendant who said she overheard a similar conversation between a woman and two young girls the same day, he said.

The attendant intervened, telling the girls to go to their parents and ordering the woman out of the restroom. The girls told the attendant that they were ages 10 and 11, police said. The woman allegedly gave the girls a business card for an adult club in western Adams County, Snell said. Police have interviewed the woman, but did not release her name or the name of the club while they investigate what could be a corruption of minors case.

"We know there's additional victims out there," Snell said. "If they were approached by this woman, we want to know about it."

Ohio- He's a former porn addict and born-again Christian who's on a crusade against the adult-entertainment industry. She's a former dancer and strip-club owner with a psychology degree who runs a national organization of adult-club executives. Phil Burress and Angelina Spencer, architects of radically different philosophies and agendas, are on a collision course. Both are scrambling for the high ground in what promises to be a short but fierce referendum campaign on Ohio's strip-club law. The fight will culminate in a statewide vote Nov. 6, assuming that backers have enough signatures to qualify for the ballot. The campaign will be well-financed -- attracting out-of-state dollars on both sides -- and closely watched nationally by political, business, religious and First Amendment observers.The battleground will span religion, morals, economics, local control and freedom of expression.

The adversaries:• Citizens for Community Values, Burress' group, successfully mounted a 2004 campaign to pass an Ohio constitutional amendment banning same-sex marriage. The organization has been criticized for refusing to reveal the source of millions of dollars in donations. • Citizens for Community Standards, Spencer's team, is backed by high-octane Ohio lobbyists and deep-pocketed club owners. Some circulators used deceptive tactics in gathering signatures for its referendum petition. Neil S. Clark, an influential Columbus lobbyist and veteran of 28 years dealing with state government, labeled it "the most complex issue I've ever been involved with." He represents the Buckeye Association of Club Executives. "The question is, 'Can we convince the public that the framers of the Ohio and U.S. Constitutions didn't want to legislate morality?'

"The referendum would decide the fate of Senate Bill 16, the Community Defense Act, passed in June by the General Assembly. The law enacted a "no touch" rule for dancers in strip clubs and clamped a midnight closing time on adult-oriented businesses, including bookstores, peep shows and massage parlors. Burress and his Cincinnati-based conservative Christian group are vigorously campaigning to preserve the law. They took the issue to the legislature this year through their own petition drive. It was approved by the Republican-controlled General Assembly, and Gov. Ted Strickland allowed it to take effect without his signature. However, opponents gathered enough signatures to put it on hold pending the outcome of the referendum. Burress said adult clubs, movies and pornography increase crime, reduce property values, speed moral decay and have a harmful secondhand effect on children. But his personal opposition runs deeper because of a past 25-year addiction to pornography that he said contributed to two divorces.

"I know the devastation personally that the sex industry can cause," said Burress, 65. "When I went through all the problems, I was one of them. That's the proof that I can present of what this does to a person."

Spencer, 40, was born in Sandusky and became a dancer in men's clubs after tiring of dead-end minimum-wage jobs. She eventually became owner of the Penthouse Club in Cleveland, which she later sold to Hustler publisher Larry Flynt. Along the way, she earned a bachelor's degree in psychology from Ursuline College in the Cleveland suburb of Pepper Pike. Now living in Naples, Fla., Spencer is executive director of the Association of Club Executives. Spencer accused Burress and company of spiritual hypocrisy. "What they want is a utopian return to the Beaver Cleaver era of the 1950s, a time when there were no women's rights." She said her years as a dancer and club owner were "the most liberating and empowering experience I've ever had."

But flashy dancers and clubs won't be the focus of the repeal campaign.

"This is about the First Amendment," Spencer said. "Adult entertainment is in the front line for freedom. What starts in adult entertainment will trickle down in other forms of media and art." Sandy Theis, spokeswoman for the repeal campaign and a former Columbus bureau chief for The Plain Dealer of Cleveland, said polling shows that the more people know about the strip-club law, the less they like it. "When people hear about this no-touch rule -- if you touch a dancer on the head or the elbow or the toe, you can go to jail for 30 days -- they're astonished."

Jeff Ortega, spokesman for Secretary of State Jennifer Brunner, said Citizens for Community Standards submitted a petition containing 382,508 signatures; at least 241,366 valid signatures from at least 44 counties are needed. He said he expects to have help from two influential national organizations -- Focus on the Family, which is led by Dr. James Dobson, and the American Family Association.

In addition, about 2 million inserts will be distributed in church bulletins, and his organization will question candidates on the fall ballot about the issue and post responses on its Web site, ohioelectioncentral.com.

David Vitter has passed a lie-detector test and will provide details of the four-month relationship at a press conference Tuesday, according to Hustler magazine publisher Larry Flynt. Wendy Cortez, whose real name is Wendy Ellis, says she had a sexual relationship with Vitter, R-La., in 1999, when he was a state legislator. Copies of the results of Cortez's polygraph test, which she took at Flynt's request, will be provided to reporters at the news conference at Flynt's office in Beverly Hills, Calif., Hustler said in a news release Monday. Vitter spokesman Joel Digrado wouldn't comment on the Flynt news conference. In an e-mail, Digrado said, "Sen. Vitter and his wife have addressed all of this very directly. Florida Councilman Commits Suicide Amid Sex Abuse Allegations

FLORAL CITY - Just hours after handing in his resignation from the St. Petersburg City Council, John Bryan drove to a property he owns in Citrus County and committed suicide. Bryan was under criminal investigation for allegedly having sexual relationships with three females in his home - two of them his teenage adopted daughters. The 56-year-old's body was discovered by a reporter for the St. Petersburg Times who went to Floral City to talk to Bryan. The Times reported he was slumped over in a golf cart inside his garage. A still running lawn mower was parked nearby. St. Petersburg Mayor Rick Baker issued a statement through a spokesperson saying "My thoughts and prayers are with the Bryan family tonight."

Councilman Earnest Williams told The Associated Press on Friday evening that he was shocked by Bryan's passing. "I was very surprised and amazed," Williams said. "He was always willing to help out other folks. It's just a sad day for everyone involved." In a resignation letter released to the media earlier Friday, Bryan wrote, "I would like to extend my sincere appreciation to the citizens of this great community for their confidence in me to represent them. It has been a pleasure to work with one of this city's finest Mayors, and extremely effective City Council, and a truly great city staff."

According to court sources, a female who used to be in the Bryan home - who is now an adult - came forward claiming she had a sexual relationship with him that began when she was still a minor. She also claimed Bryan had sex with his two adopted teenage daughters. Bryan claimed in court that the relationship with the older girl took place after she became an adult - and was consensual. He denied having any sexual relationship with the two younger girls. According to a bio on the St. Petersburg city website, Bryan was married with three grown children and two school-aged children. Bryan was first elected to the District 2 Council seat in 2001, and re-elected in 2005. Before seeking office, he retired from his own business Bryan Homes - which has built over 300 homes in the St. Petersburg area.

Platinum Gold strip club owner Norman Goddard, 7 others arrested; Strippers Sold Drugs

Florida- Boynton Beach police arrested a strip club owner and seven others Friday night after an undercover operation into sex and drugs at the club. The Police Department's Community Action Team conducted surveillance at Platinum Gold, 3675 S. Federal Highway, for more than a month. Dancers allegedly kept drugs in their lockers and sold them, with a chunk of the profits going to owner Norman Goddard, 53, of Boca Raton, police said. Dancers also paid Goddard a portion of the $300 they would charge to have sex in the champagne room, said Sgt. John Bonafair, of the CAT. If Goddard saw the dancers engaged in sex acts with men on the couches he would get angry because they weren't paying the $300 entry fee to the private room, Bonafair said. "Then they would do whatever you wanted based on any additional moneys," he said. "When we turned over the couches, it was littered with used condoms and condom wrappers."

Bonafair said there was also evidence of drug use in the private room. The club has long been known in the neighborhood for sex and drug activity that fueled robberies, shootings and drug trafficking in the area, Bonafair said. This year's investigation, dubbed Operation Southern Comfort, stemmed from community complaints, police said. During an undercover investigation, one officer was solicited for sex, police said. Police were not able to shut the club down. The investigation is ongoing and police are seeking to have the state seize the club's liquor license, worth an estimated $250,000. It can then be auctioned off by the city. Police seized $12,000 and two vehicles and expect to seize three more vehicles and make more drug arrests.

Arrested Friday were Goddard, charged with drug trafficking and keeping a house of ill fame and deriving the support from proceeds of prostitution. In 1984, he was convicted on a drug trafficking charge, state records show. Also arrested on drug charges Friday were club disk jockey James Pankraz, 24, of Lake Worth, who has previous drug arrests; Jean Blain, 36, of Delray Beach; Joshua Ousley, 18, no address; Katie White, 22, of Stuart; Christopher Frynkewicz, 24, of Boynton Beach; and a 17-year-old girl. Melinda Ventre, 23, of Pembroke Pines, was arrested on drug charges and solicitation of prostitution. "It was successful and we got our point across," Bonafair said.

"Whether he shuts down or decides to leave, we definitely curtailed the kind of activity that was going on down there." Staff Researcher William Lucey contributed to this report.

Uncle Sam now owns Crazy Horse Too

Las Vegas- Another page in the saga of Rick Rizzolo was written Wednesday when U.S. marshals seized the notorious Crazy Horse Too, his former strip club on Industrial Road. The federal government's move is its latest attempt to extract $17 million in court-ordered fines, forfeitures and settlements from Rizzolo, who received a 366-day prison sentence after pleading guilty last year to tax evasion. The seizure, which enables the government to sell the property or collect rent from it, was approved in an order signed this month by U.S. District Judge Philip Pro.

Rizzolo became the club's majority owner two years after his father bought it in 1984. Over time he transformed the small operation into a 26,000-square-foot business with 1,500 dancers and monthly gross sales of $800,000 to $1 million. He estimated that the business attracted 600,000 to 700,000 customers a year. As the cash rolled in Rizzolo became a major political contributor. But law enforcement authorities long alleged that he and some of his employees had ties to reputed mobsters. And the rough treatment some of Rizzolo's customers received generated negative headlines over the years.

The biggest of those centered on customer Kirk Henry, who was paralyzed as the result of an altercation at the club in 2001. He sued Rizzolo and was awarded $10 million, still unpaid. The government's seizure of the club, which was closed last month when the Las Vegas City Council revoked its liquor license after a proposed sale fell through, came as welcome news to neighboring businessman "Buffalo" Jim Barrier, a repair shop owner and wrestling promoter who has a pending $1 million harassment lawsuit against Rizzolo ."I knew it was coming," Barrier said of the seizure. "The government had to do it to get the money to pay off the people Rizzolo owes money to, because he doesn't want to pay anybody a dime. So I'm very happy. It's a day of celebration for me."

The government action means an uncertain future for the club, although there are offers to buy it , ranging from $29 million to $34 million. The U.S. attorney's office and Rizzolo 's attorney Anthony Sgro did not return calls Wednesday.
